Ukraine Supreme Court rejects Gazprom`s appeal against $3.4 bln monopoly fine

The Supreme Court of Ukraine has refused to consider a claim filed by Russian gas monopoly Gazprom seeking to challenge a decision by the Anti-monopoly Committee of Ukraine (ACU) to fine the company UAH 85 billion (about $3.4 billion) for abusing monopoly on Ukraine`s gas transit market.

A relevant court decision was published in the national state register of court rulings.

”Having considered the grounds set forth in the claim [submitted by Gazprom] and analyzed the materials attached to it, the panel of judges finds the claim groundless,” the decision reads.

The Supreme Court thus decline to initiate proceedings for the claim, it said. The court decision is final and not subject to further review.

As UNIAN reported earlier, in January 2016, the ACU fined Russia`s gas company Gazprom UAH 85 billion due to abuse of monopoly position.

The decision was prompted by a Ukrainian government order and was in line with formal charges brought by the European Commission against Gazprom for abusing its dominant market position in Central and Eastern European gas markets in breach of the European Union`s antitrust rules.

In April 2016, Gazprom decided to appeal to the Commercial Court of Kyiv to challenge the decision of Ukraine`s Anti-monopoly Committee.
