Ukraine`s Rada OKs law on defense order with president`s amendments

The Verkhovna Rada, Ukraine`s parliament, has passed a law on defense order with Ukrainian President Petro Poroshenko`s amendments, extending the period of placement for the government`s defense orders for up to three years instead of one.
Amended law No. 2090a on amendments to the Law ”On State Defense Order” was supported by 258 MPs with the required minimum of 226 votes.
Presidential envoy in parliament Artur Herasimov said while presenting the amendments that the previous wording adopted on January 26 this year could not have been signed by the head of state for a number of reasons.
”The law, which was submitted for his [president`s] signature, included such definitions as `beyond defense order,` `in exceptional cases,` `in emergency,` but their essence did not correspond to the principles of legal certainty of legal norms allowing their arbitrary interpretation while their implementation,” Herasimov said.
He also noted that it is proposed that three years should be allowed for the placement of a defense order, and the term of its approval by the Cabinet of Ministers should be limited to one month from the date when the law on a budget for the respective year becomes effective.
As stated in an explanatory note to the bill, the government will set clear rules for price formation regarding the goods purchased for defense purposes. Purchases of weapons, military equipment and ammunition, as well as modernization and repairs (except maintenance repairs) will be carried out solely in keeping with the defense order.
As UNIAN reported earlier, Ukraine`s new Military Doctrine enacted by the presidential decree of September 2, 2015, provides for that Ukraine should spend at least 3% of its GDP on defense purposes annually.
The Ukrainian parliament increased the amount of funding for Ukraine`s Defense Ministry in 2016 by 21% to UAH 55.6 billion, as compared to UAH 45.8 billion allocated in 2015. In particular, UAH 42.6 billion was earmarked to support the Armed Forces of Ukraine and train troops; UAH 4.7 billion has been allocated for the development of armament and equipment for the Ukrainian army. Additionally, UAH 1.5 billion has been earmarked for medical treatment, rehabilitation of the personnel of the Armed Forces of Ukraine and war veterans. Moreover, UAH 2.2 billion will be allocated for training of military specialists at higher educational institutions, as well as for further training and advanced training of the military.
