Ukraine okays draft reform of state intellectual property system

Ukraine`s Ministry of Economic Development and Trade has approved a draft document for an overhaul of the state system of intellectual property legal protection, the ministry`s press service reported.
Ukraine`s trade envoy Nataliya Mykolska stated that the reform concept envisages the creation of a national intellectual property authority on the basis of Ukrpatent and the State Intellectual Property Service of Ukraine.
”The national intellectual property authority will change the system of state governance in relation to intellectual property. It is about the creation of a ”one-stop shop” for obtaining intellectual property documents, developing intellectual property culture and creating that sphere in the country,” said Olena Minich, the director of the Economic Ministry`s Innovation and Intellectual Property Department.
As UaPosition reported earlier, on February 18, the Cabinet of Ministers decided to dismiss Chief of the State Intellectual Property Service Alla Zharinova, who had been head of the agency since November 2014. The decision on her dismissal was based on results of an official investigation.
On February 24, the government appointed Antonina Malysh as acting head of the State Intellectual Property Service until the appointment of a new chairperson in accordance with the established procedure.
The Ukrainian parliament on February 3 ratified a protocol amending the Agreement on Trade-Related Aspects of Intellectual Property Rights (the TRIPS Agreement, concluded in the framework of the World Trade Organization), which would allow exports of medicines produced under a special `compulsory licensing` mechanism, that is when the government allows the production of a patented product or use a patented process without the patent holder`s permission.
